Terms of service.

By creating an account or using bakatako.com (“Bakatako,” “the Service”) you agree to these Terms. If you don't agree, please don't use the Service.

Bakatako is a social platform for doodles. We give you tools to draw, post, react, remix, and follow other artists. Core features include the daily prompt feed, drawing rooms, profile pages, original characters (OCs), and lightweight community games. We add and retire features over time.

• You must be 18 or older to create an account.
• Provide accurate information at signup and keep it current.
• You're responsible for activity under your account; keep your password safe.
• One human, one account. Don't share or sell access.
• We may suspend or terminate accounts that break these Terms or harm the community.

You keep all rights to the doodles, replies, comics, and other works you make on Bakatako. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, distribute, and back up your content so we can run the Service. This license ends when you delete the content (except for backups that age out on schedule, and copies others have already saved).

You confirm that you own — or have permission to use — anything you upload, including reference images, audio, and brushes.

Bakatako is collaborative. By posting a work, registering an original character (OC), or sharing a brush pack, you grant other users a non-exclusive license to build on it on Bakatako — remixing your work, replying to it, drawing your OC, or installing and drawing with your brushes. This license covers use on the platform only; it doesn't let anyone use your art outside Bakatako without your permission, and it ends for new uses when you delete the content (existing remixes and replies remain).

Don't post

• Sexual content involving minors. Ever.
• CSAM, doxxing, harassment, or threats of violence.
• Hate speech or content targeting people based on protected characteristics.
• Other people's art passed off as your own.
• Spam, malware, scams, or anything illegal where you live or where the Service operates.

We may remove content that violates these rules and take action on the account. Bakatako is operated for humans making things together; we'll err toward keeping it that way.

Anyone can report a work, reply, or profile. We review reports as quickly as we can. Decisions are made by people with help from automated tooling — we may temporarily hide content while we review. If we get it wrong, email us and we'll take another look.

• Bakatako may offer optional supporter memberships. Current prices and perks are shown on our pricing page and at checkout.
• Supporter memberships renew automatically until cancelled. You can cancel any time from your account; supporter status continues until the end of the paid period.
• Prices may change with at least 30 days notice.
• Refunds are at our discretion and generally limited to billing errors.
• Payments are processed by Stripe. Their terms also apply to billing.

Bakatako may offer virtual currency (Baka Bucks) and other virtual items earned through activity on the site or our Discord server. They have no real-money value, can't be redeemed for cash, and can't be sold or transferred outside the platform. We may adjust balances to fix bugs or abuse, and may change or retire virtual-item features over time. Virtual currency and items are forfeited if your account is terminated for breaching these Terms.

Eligible users can host drawing contests on Bakatako. Contest entries are normal works and everything in §4 applies to them. Hosts choose the winners (directly or via community vote) and are solely responsible for any prizes they offer outside the platform — Bakatako doesn't guarantee, deliver, or arbitrate third-party prizes. We may edit or remove contests that violate these Terms.

We may use automated or third-party services to help operate the platform, including moderation, spam prevention, prompt scheduling, email delivery, payments, hosting, and analytics. These tools support the service; they do not change your responsibility for what you post.

The Bakatako name, mascot, logo, source code, and original UI elements are ours. You may not copy or reuse them without permission, except where covered by an open-source license we've granted. Nothing in these Terms transfers ownership of our IP to you.

If we offer API access (paid or otherwise), keep your API keys confidential, respect rate limits, and don't use them to scrape user data, impersonate other accounts, or train ML models on user content. We may revoke keys that get abused.

The Service is provided “as is” and “as available,” without warranties of any kind. We don't guarantee uptime, uninterrupted access, or that your work will reach a particular audience. We do try our best.

To the maximum extent allowed by law, Bakatako and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim — or US$50 if you didn't pay anything.

You agree to defend and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or someone else's rights.

We may update these Terms as the product evolves. We'll post the new version here and update the “Last updated” date; material changes get a heads-up via email or an in-app notice. Continued use after the effective date means you accept the changes.

You may stop using Bakatako and delete your account at any time. We may suspend or terminate access for breach of these Terms, fraud, or to protect the platform. Sections that should reasonably survive termination (IP, your content licenses for residual backups, liability limits) survive.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
